MERS vs. MERScorp – Looks Like They are One-in-the-Same

How many times have you seen opposing counsel argue in a Motion to Dismiss that MERSCORP, Inc. should not be a Defendant in the lawsuit? They allege, for example: “Plaintiffs do not allege that they had any dealings with Defendant MERSCORP, nor that Defendant MERSCORP is a party to or drafted any of the documents relative to their loan, or took any action against them?”  Well, folks – MERS and MERSCORP, Inc. are apparently one-in-the-same… it appears to be a “dba” at best…. New evidence, anybody? [Ed. note: I stand corrected referring to the comment below; not even “dba” is adequate.  See AMERICA WHOLESALE LENDER v. PAGANO stating,“We conclude that, because a trade name is not an entity with legal capacity to sue, the corporation has no standing to litigate the merits of the case.” Check your state and local case law.]

How & Why the Big Banks’ Lobbyists Killed Foreclosure Mitigation

BIG BANKS OWN CALIFORNIA TOO
By Lee Fang, October 8, 2011

As the 99 Percent Movement takes shape across the country, citizens are demanding that Congress represent the public interest instead of the whims of bankers and big corporations. For instance, after demanding and receiving massive bailouts, Wall Street banks successfully lobbied Congress to crush any serious effort to mitigate the foreclosure crisis. The spectacular bank lobbying coup in Washington prompted Sen. Dick Durbin (D-IL) to remark that the banks “frankly, own the place.” [read more on NationofChange.org].

And the answer to the $10 million question…. Whose fault is that, Dick? Tic toc, tic toc…. Continue reading

Occupy Wall Street – Focus on Our One Demand

The poster of this news clip is correct – this is what we should be focusing on. “Dylan Ratigan knows what he’s talking about and the way he says it is too epic. So spread this video and let the people know this should be what OWS should be focusing on. That this has to be our one demand.”  Thank you Dylan, for your passionate message.

Dylan Ratigan is clear about what is happening to our country – listen up citizens. It doesn’t matter if Continue reading

Elizabeth Warren: ‘Wall Street Broke This Country — One Lousy Mortgage At A Time’

Zeke Miller | Oct. 9, 2011, 11:28 AM

Massachusetts Senate candidate and former Obama administration official Elizabeth Warren laid into the financial sector for their role in bringing about the recession.

Asked about her position on the Occupy Wall Street protest at last week’s Massachusetts Senate debate, Warren said that people have to follow the law, then immediately launched into an invective against the banks.

“The people on Wall Street broke this country, and Continue reading

Wall Street Protests: A Good Place to Start
By Sen. Bernie Sanders, The Boston Globe
07 October 11

he protest movement called Occupy Wall Street has struck a nerve. The demonstrators’ goals may be vague, but their grievances are very real. If our country is to break out of this horrendous recession and create the millions of jobs we desperately need, if we are going to create a financially-stable future, we must take a hard look at Wall Street and demand fundamental reforms. I hope the protesters provide the spark that ignites that process.

The truth is that millions of Americans Continue reading

Death, Depression, Desperation and Despair; the homelessness of foreclosure is an atrocity of untold magnitude

In an effort to appear hunky-dory for the APEC Summit embarking on its shores in November 2011, Tulsi Gabbard and Honolulu city council wanted to pass legislation (Bill 54) to be able to “dispose” of the belongings of street people, many of which are families that have been displaced by foreclosure – a growing number that has been largely ignored by state and federal governments.
