As the 99 Percent Movement takes shape across the country, citizens are demanding that Congress represent the public interest instead of the whims of bankers and big corporations. For instance, after demanding and receiving massive bailouts, Wall Street banks successfully lobbied Congress to crush any serious effort to mitigate the foreclosure crisis. The spectacular bank lobbying coup in Washington prompted Sen. Dick Durbin (D-IL) to remark that the banks “frankly, own the place.” [read more on].

Senate Lawmakers Want Tough Approach In Foreclosure Talks

In June 2011, Senate Democrats were calling on a federal bank regulator to take a tougher approach in fixing problems in banks’ home-foreclosure practices and make sure that homeowners receive assistance.

“We urge you to take every opportunity to ensure that servicers not only account for past harms, but also take steps to prevent future servicing deficiencies so that homeowners going forward are treated fairly,” the senators said. [read more]

They apparently didn’t even have a clue. See the list of imploded mortgage lenders below – ahhhh, you guys need a magic wand or something?

Well, Senators – just how do you plan on implementing a “fair” plan when there are only six (6) banks left that can deal with these fraudulently inflated mortgages, bad paper and clouded titles? Let’s get realistic here and do some math.  Mortgage Electronic Registration Systems, Inc. (MERS) alone had 71 million +/- mortgages logged in its system.  We have over $13 TRILLION (U.S. dollars) in inflated mortgage paper spread around in over $140 TRILLION (U.S. dollars) of over-leveraged securities (“it was an experiment” that went terribly wrong).

The investors of these fraudulent securities want out claiming they were duped by inflated appraisals, systematically abandoned underwriting guidelines and over-rated bonds. No other investors want to come in because there are no regulations or safe guards in the derivatives scheme. So, where in the hell are these mortgages supposed to go? Huh?

The Wall Street crooks had “pretender lenders” that actually wrote and originated the mortgages that the banks sold to investors.  Most of these slick pretender lender entities were NOT banks – they were brainchildren of mortgage moguls like Angelo Mozilo and Bill Dallas.  Banks agreed to buy these loans to securitize and apparently also used some of the same assets to pledge for collateral to fill their warehouse lending coffers. After what appears to have been a planned exit strategy, the pretender lenders started dropping like flies after a shot of Black Flag.

But Senators, there were millions upon millions of mortgages written through this massive unregulated con game and now these hustles are gone, closed doors, shut down and bankrupt. How can you even remotely expect federal bank regulators to carry out a mandate to make sure homeowners are “treated fairly”?

Ladies and gentlemen, I present to you the bold fact that the banks and their hundreds of pretender lenders compadres wrote more loans than they can “legally” hold.  They were unsupervised, unregulated and allowed to run wild – on your watch.

If you want to treat homeowners fairly, realize the majority of homeowners based their decision to purchase a mortgage (not a securities option which is what it appears they were really sold) on an appraisal that was now known to have been inflated by the banks – NOT by the homeowner, but by the lenders. Fraudulently inflated appraisals are at the very root of this crisis.

The lenders had systematically abandoned their underwriting guidelines and concocted the price of the loan on the “credit-risk” algorithms and shared information data analysis of the borrower. It was on the borrowers’ “ability and willingness” to pay and then the lenders went shopping for an appraisal who would give them that number. Bottom-line is that the borrowers’ appraisals were fraudulently inflated!

The banks are going to foreclose because they are forced to pay back the investors who have sued for fraud and/or have settled with for various reasons – not the least of which are related to deceptive business practices. There are not enough banks or money to modify all of these mortgages that they wrote and scammed America with – so you have to do something bold and out of the box. This is a cold, hard fact and issue that doesn’t fit nicely into any plan you have had to date.

Once you realize that (1) the borrower was duped and had no disclosure, (2) the investor was duped but had more disclosure than the borrower, and (3) there are more loans than institutions to hold them; then realization that the best way to remedy this situation and treat everyone fairly is to find somewhere to house (hold) all of these mortgages and reconstruct them with the homeowners at current market values (yes, reduce the principal) at 2% for 30 years (in lieu of litigation).

As U.S. Senators you’ll have to tell the investors they will have to live with less risk and less liquidity – which is better than losing everything and certainly better than a revolution…. It’s your choice, Senators – but wise up because press releases like the “treated fairly” piece make you appear like you don’t have any idea what is really going on and that your staffs haven’t done their math homework. Are you just finding out there are more bodies than body bags?

  1. No wonder that WFHM has refused my three attempts at a QWREQUEST, including one filed by a practicing attorney and most recently when asked to produce a copy of our title record, mailed us one dated May , 2011 from Transland Financial – defunct since 07-08 !
