Credit Default Swaps: The Insane Problem and the Radical but Sane Solution

With nearly 4 solid years of foreclosure injustice spewing from the courts and millions of homeowners continuously getting skunked, it has become a necessity to figure some way to explain to even the brightest (judge) on the bench the answer to, “[D]id you pay?” 

It doesn’t matter what state (although some are a lot worse than others) or what faction of the judiciary, state, federal, bankruptcy, appellate – the question they always ask, “[D]id you pay?”  We’ve all heard the standard answers:

  • “I don’t know who to pay…”
  • “I owe someone, but it’s not these guys…”
  • “I lost my job, but I can pay now and they won’t take my money…”
  • “All I need is a little reduction in my monthly payment…”

The list goes on – but the real answer if there is a trust involved might be, “Well, your honor, I don’t think I’m in default.” And of course the judge is going to say, “why is that – did you pay?” And the likely response might be, “your honor, there’s these things called Credit Default Swaps and my note is Continue reading

Bank of America bribes donates to Congress for 2012 Elections.  

Bank of America, whose stock has been tanking for over a year and appears on the verge of bankruptcy, has donated hundreds of thousands of dollars to the 2012 Congressional elections.  How stupid is that?!

Not only are the political donations absurd given the fact that Bank of America has taken $1.344 TRILLION ($1,344,000,000,000) from the Federal Reserve (see page 131 of the audit report) since 2007… These are public funds (yours and mine) used to “prop” up a failing bank that apparently is under-collateralized. MERS vs. MERScorp – Looks Like They are One-in-the-Same

How many times have you seen opposing counsel argue in a Motion to Dismiss that MERSCORP, Inc. should not be a Defendant in the lawsuit? They allege, for example: “Plaintiffs do not allege that they had any dealings with Defendant MERSCORP, nor that Defendant MERSCORP is a party to or drafted any of the documents relative to their loan, or took any action against them?”  Well, folks – MERS and MERSCORP, Inc. are apparently one-in-the-same… it appears to be a “dba” at best….
